Presented by Jonathan M. Crotty of Parker Poe.  Jonathan is the practice group leader for Parker Poe’s Employment, Benefits, and Immigration group.  He is a practicing attorney who has been representing management for over 30 years. 

This session will include:

  • A review of recent court decisions that have significantly narrowed the scope of enforceable post-employment restrictions.
  • The legal process for enforcing post-employment restrictions.
  • Business issues involved in deciding whether to pursue litigation in cases of potential breach of post-employment restrictions.


Session objectives

  • Understand the types of post-employment restrictions available to employers.
  • Understand the limits of restrictions in terms of time, territory and scope.
  • Explain how employers use threat of litigation to leverage questionable restrictions.
